Terms of Service

1. Acceptance of Terms

By accessing or using the Tethyr platform, software, API, or related services (collectively, the "Services") provided by Tethyr ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you are accepting these terms on behalf of a company, school, nonprofit, or other legal entity, you represent that you have the authority to bind such entity to these terms.

2. Description of Services

Tethyr provides a digital infrastructure platform connecting registered businesses ("Merchants") with registered nonprofit organizations, schools, or teams ("Organizations") to facilitate digital product fundraisers. Tethyr provides the technical conduit, storefront hosting, and payment routing infrastructure to process transactions. Tethyr is explicitly not a retailer, distributor, or manufacturer of goods.

3. Account Registration & Responsibilities

  • Accuracy: Information provided during registration must be accurate, current, and complete. Tethyr reserves the right to suspend accounts with fraudulent, deceptive, or systematically incorrect data.
  • Security: You are responsible for safeguarding your authentication credentials. Tethyr is not liable for unauthorized access resulting from the mishandling of access links, passwords, or authentication keys.
  • Compliance: Merchants and Organizations agree to use the Services strictly for legal, ethical retail and fundraising purposes. Any violation of local, state, or federal law via the platform is strictly prohibited.

4. Payment Processing & Fees

Payment processing services for merchants on Tethyr are provided by Stripe and are subject to the Stripe Connected Account Agreement (which includes the Stripe Terms of Service). By using Tethyr, you agree to be bound by the Stripe Services Agreement.

Tethyr deducts a platform maintenance fee from the Merchant's gross sale amount as detailed in our pricing schedules and specific dashboard readouts. Donors may independently opt to cover standard processing fees at checkout; otherwise, these standard interchange fees are borne by the Merchant.

To ensure total fulfillment of campaign promises, Merchant wholesale revenues are disbursed upon campaign finalization, while the Organization's designated shielded profit margins remain securely held by Tethyr until physical distribution of the underlying goods is completed.

5. User Conduct and Restrictions

You agree not to:

  • Reverse engineer, decompile, disassemble, or circumvent the core algorithmic systems of the platform.
  • Attempt to artificially inflate transaction volume via fraudulent cards or bot networks.
  • Use the platform to sell restricted, illegal, or heavily regulated goods (e.g., firearms, alcohol, controlled substances).
  • Impersonate another Merchant or Organization.

6. Limitation of Liability

To the maximum extent permitted by law, Tethyr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues (whether incurred directly or indirectly), resulting from: (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; or (iii) unauthorized access, use, or alteration of your transmissions or content.

7. Modifications to the Terms

We reserve the right to modify these terms at any time completely at our discretion. Notice of major material changes will be communicated via the platform dashboards or the email associated with your administrative account. Continued use of the platform after any such updates constitutes acceptance of the new terms.
